TERMS AND CONDITIONS OF SALE
The following terms and conditions apply to all transactions at NuWay Electrical. The use of this site indicates your acceptance of these terms and conditions. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference.

General
These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age and accept delivery within the UK. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

Description of Goods
All the products we sell are of a technical nature and where possible we supply detailed descriptions and specifications, however, it is not practical to publish this information for all of our products. All images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods. Full detailed specifications are available from the manufacturers brochures or their websites.

All accessories supplied with a product are subject to upgrade or change at the manufacturers discretion. We will supply the product(s) as supplied to us by the manufacturer.

Competitor Prices
Wherever quoted, our competitor prices would relate to local retailers e.g. Comet, Dixons, Currys and Local independents etc. The store in question must be within 10miles of either one of our stores. The pricing information have either been made accessible by suppliers, manufacturers, retailers, publications, or been gathered from public-domain sources. We will try our very best to match or even beat any of our competitors 'Instore' prices, like for like, including any delivery or installation costs. Product in question must be available immediately for collection or delivery from a local store and must be a stock item. We will NOT match; Internet Retailers, Trade Warehouses, Catalogues or Mail Orders due to the difference in running costs and our commitment to providing you with the best possible service via our highly trained and knowledgeable sales staff. We will also not match; Web Exclusives, One-off special offers, One-day Spectaculars, Products with have been damaged or used on the display of our competitor. In the event of a 'free' or discounted item being offered with some products, which we don't normally stock or are unable to acquire, we will simply match the total price without the said product applicable. This will be subject to the terms listed above. We reserve the right not to match any price if we believe we cannot guarantee the above criteria is met to our satisfaction.

Accuracy of Product Information
All product specifications, images and other information published on our website have either been made accessible by suppliers, manufacturers, publications, publicists, or been gathered from public-domain sources. The intention of Nuway.co.uk is that all information on the website should be as accurate and up to date as possible. However, Nuway.co.uk cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual.

Payment and Price
The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our suppliers prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order. All prices on our website are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time of placing your order.

Card Information
When you purchase from us, your card information is sent to a secure server. Your card information is not processed on-line, and so each time you place an order you will be asked to re-input your card details. We feel that this helps to add extra security for you - knowing that your information is not held on a server.

Typographical Errors
In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery charges).

Payment Methods
On the order you must provide us with your exact billing address and telephone number - the address and phone number your credit card bank has on file for you. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received. You may also pay by cheque or postal order although we cannot dispatch the goods until payment has been cleared which can take at least 7 days.

Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

Delivery Charges
All prices on our website are exclusive of delivery charges which will be added to the price of the products at our checkout or later if installation is required costs would be quoted before confirmation. Delivery prices quoted are for local addressess only, Hull and surrounding areas, for more information please contact your nearest branch and costs will be explained. Deliveries are daily (excluding Wednesday and Sunday) and operate on an AM or PM basis. Morning deliveries (AM) are usually between the hours of 9am and 12.30pm. Afternoon deliveries are between 2pm and 6pm (5.30pm on Saturdays). Every effort is made to work within these times but problems may arise when we run late, We will try our utmost to inform you of any delays prior to delivery.

Delivery Times
Delivery of any stock item will normally be made within 2-5 working days from clearance of payment. Some major domestic appliances are delivered direct from the Manufacturers and may take up to 7-10 working days from clearance of payment. We will endeavor to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes outside our control. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods. If we or our suppliers are temporarily out of stock, we will notify you of this position and you should allow up to 14 days for dispatch of the goods. For delays of more than 14 days, you will have the right to cancel the order and we will refund any money paid by you for the goods.
Installation will be carried out by our qualified delivery drivers at the time of delivery if his has been arranged at the time of order.

Risk
As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery.

Time Limitation For Notification of Claims
Damage in transit: If goods arrive in a damaged condition you must make a note on the carriers delivery note and it will be your responsibility to inform us within 7 days from delivery.

Shortages: It is your responsibility to sign for the correct number of packages as shown on the carriers delivery note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 10 days from delivery.

In-Correct Goods: It is your responsibility to notify us of any in-correct goods supplied within 7 days from delivery.

Non-Deliveries: We will not accept liability for goods lost in transit unless we are notified within 10 days from the expected delivery date.

If goods returned under this clause are found to be perfect and in full working order, these will be returned to you and an administration fee of 15% of the price of the goods along with the cost of carriage will be charged.

Product Guarantees - General
All products supplied are covered by the terms and conditions of the Manufacturers Guarantee for a minimum period of 12 months. This guarantee specifically excludes faults caused by accident, neglect, and misuse. In addition routine maintenance (cleaning of dirty audio/video heads etc.), consumables (styli, plug fuses, cables, batteries, etc.), cosmetic damage and tuning of channels is not covered. THE FULL COST OF THE SERVICE CALL WILL BE CHARGED IF OUR ENGINEERS FIND NO MECHANICAL OR ELECTRICAL FAULT WITH YOUR PRODUCT. This does not affect any statutory rights that you may have.

Product Guarantees - Plasma and LCD Televisions
The screen or 'panel' on Plasma and LCD displays is made up of thousands of tiny pixels. A 26" flat-screen with a resolution of 1366 x 768, for example, has 1049088 pixels. Each pixel comprises three sub-pixels (red, green and blue) so on the 26" above, there are just over 3.1million dots in total. Behind each pixel is a transistor. When a transistor fails it manifests itself as a bright, dark or coloured dot on the screen that stands out from the rest.

Todays production techniques unfortunately cannot guarantee an absolutely fault-free screen display and although this is very rare for the quality manufacturers which we deal with, buyers should be aware of the possibility of imperfections (in the form of a few isolated constantly lit or unlit pixels) before choosing to purchase a Plasma or LCD television.

Due to this, there is indeed a commonly accepted tolerance level by which Plasmas or LCDs may display such imperfections (or stuck pixels) without being classified as faulty. As such, we can only take back displays as faulty for refund/repair IF the number of stuck pixels exceeds the manufacturers guidelines.

The number required for the monitor or television to be classed as faulty does vary between manufacturers. Please check with the relevant manufacturer as to their ‘tolerance level’

Cancellation of Orders:
Returns Policy

No Fault
You are entitled to withdraw from this contract within 7 days from delivery of the goods for a full credit or refund less any applicable delivery charges. The goods must be unused and 'as new' in their original box and packaging including all manuals and accessories. You must notify us within 7 days from date of delivery. It will be your responsibility to return the goods to us at your own cost and risk. Goods received back 'as new' but incomplete with missing components and accessories, the cost of the accessories will be charged to you. Goods received back in any condition other than 'as new' will be returned back to you.

Faulty Returns - Dead on Arrival
A product is deemed to be 'dead on arrival' if it shows symptoms of hardware failure preventing basic operation upon its first use out of the box. In such instances please contact us via telephone or email within 7 days from the delivery date. You can then either return the faulty item directly yourself or we will organise a collection from your home (not applicable if the item was collected from us). Upon receipt of the goods and confirmation of the fault by our technical engineers you will be offered the following options:

1. A replacement of this item will be replaced at our own expense.
2. A repair of the repaired item will be shipped to you at our own expense. Please note that once repaired the product is no longer eligible for replacement.
3. A full refund, provided the item has been verified faulty and is complete with all accessories in its original box and packaging.

If the product is not deemed to be faulty by our technicians then you will be offered the following options:

1. Return of the goods & the cost of delivery charged to you.
2. Refund at the invoice cost less any applicable delivery charges provided the product is 'as new' and complete with all accessories in its original box and packaging. If the condition of the product or the packaging is poor then we reserve the right to impose a charge to cover re-packaging costs. Missing accessories will also be charged to you.

The manufacturers guarantee will apply to all items reported to be faulty after 7 days from delivery. This guarantee then becomes a 'repair' guarantee and in the event of a fault would not be replaced.

This returns policy does not affect your legal rights.

Other
You will own the goods once we have received your payment in full. We do offer credit facilities, but this is an agreement which must be completed instore. We will issue you with an electronic invoice once we have dispatched the goods to you. Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions. These terms and conditions are subject to change at any time without prior notice to you.
